Dataset Description

The Office of the Judge Advocate General oversees the administration of military justice. They offer legal advice to the Governor General and the Minister, as well as at bases and wings, and all across National Defence. They provide lawyers to defend accused persons at courts martial, teach courses to military members, and advise commanders on the ethical and legal principles established by both the Canadian Armed Forces (CAF) and the Government of Canada.

This dataset includes the summary of results of completed case files. A case file is opened for every accused that requests Defence Cousel services and is considered the official record for the Director of Defence Counsel Services. A completed case is a case that has either been withdrawn, non-preferred or went to Court Martial and the Court Martial is over. The results of these completed case files include findings at court martial, stay of charges, withdrawal of charges or non preferral of charges which will bring the file to a close.

The court martial – a formal military court presided over by a military judge – is designed to deal with more serious offences. Courts martial are conducted in accordance with rules and procedures similar to those of civilian criminal courts and have the same rights, powers and privileges as a superior court of criminal jurisdiction with respect to all “matters necessary or proper for the due exercise of [their] jurisdiction.
