This study provided input to the impact assessment accompanying the proposal for a Regulation on harmonised rules on fair access to and use of data (Data Act, adopted on 23 February 2022).
The study was divided into four tasks, for each of which the contractor explored the state of play in Europe and determined the impact of a number of possible policy options.
The tasks, which deal with issues that affect relations between actors in the data-agile economy, are as follows:
- business-to-government (B2G) data sharing for the public interest (i.e. for the development of better policies and delivery of better public services);
- measures supporting citizen empowerment (‘human-centric data economy’) (i.e. possibilities for empowering citizens and putting them even more in control of their data, building on the General Data Protection Regulation and establishing a human centric data economy);
- measures clarifying and potentially further developing rights on co-generated data and business-to-business data sharing (in particular in the context of connected and Internet of Things devices); and
- measures supporting companies in cases of conflict of laws at international level (including possible obstacles for businesses subject to extra-territorial provisions and foreign jurisdictions).
